Overview of the changes in legislation from June-August 2017

In the legislation overview that is presented, you can familiarize yourselves with the key legislative amendments that impacted various areas and industries in the Russian economy. The “Law on strategic planners” was amended to establish additional restrictions on foreign investment in Russian society that could have strategic significance for the country’s defense industry and national security. Amendments entered into force aimed at introducing a pricing mechanism that uses the so-called "alternative boiler house” method to create stable conditions to attract investment into the field of district heating. The “forest amnesty” law was passed, which defines the procedures for determining the borders of plots of land that constitute part of the national forest reserves. On July 30th, 2017 the President of Russia signed a law that bans the use of technologies, information systems, and programs (anonymizers and VPN services) that allow circumventing blocked content and gaining access to information resources with content that is prohibited inside Russian Federation borders. The Russian Federation Ministry of Economic Development, in accordance with official instructions from the Russian government, drafted a bill that defines the basic principles for licensing activity, which is taken to mean activity performed by executive authorities to grant permits and perform related functions. At present, it is going through the stage of legislative impact assessment.

Overview of legislative changes from March – May 2017

In the new review, we would like to draw your attention to some important legislative changes that occurred in the spring of this year in the field of construction, antimonopoly regulation, labor law, and tax law. The Russian Ministry of Construction issued decrees that ratified the methods to be used to determine cost estimates for construction materials. Substantial changes have been introduced into Article 14.32 in the Russian Federation Administrative Offenses Code that establish the liability for signing anti-competitive agreements and implementing impermissible concerted actions. On March 28th, 2017 the Russian Federation State Duma introduced a bill for a federal law that would significantly restrict employers from demanding work days with irregular work hours. Another bill is going through public debate that obliges legal entities to gain knowledge of any beneficial owners that might exist, to take steps to identify them, and also to present information about them to the Russian Federal Service for Financial Monitoring and the Federal Tax Service upon request. to help combat both the legalization (laundering) of funds that have been acquired by illegal means and the financing of terrorism.

Overview of changes in legislation during October-December 2015

In this review of legislation, we will tell you about the key changes in the “fourth antimonopoly package”, which entered into force on 5 January 2016, and which will largely contribute to the liberalization of antimonopoly regulations, and are intended to focus the work of the antimonopoly authorities on violations that really affect the state of competition. The newly adopted law, which aims to strengthen the payment discipline of energy consumers, and increasing responsibility in case of violations of the set energy consumption limits; It provides for “an irrevocable bank guarantee" as a mechanism for fulfilment of obligations on payment of the cost of energy consumed; stricter administrative responsibility for cases of unauthorized connection to electric, heat, oil and gas networks. Federal Law dated 30.12.2015 No. 459-FZ specifies requirements for cultural heritage objects, ensuring the safety and permanence of historic buildings within their historic settlements. The Russian Government introduced a bill aimed at improving the security of participants in shared construction projects, and transparency for activities of developers.

Legislation update for the end of 2016 / early 2017

The legislative changes covered in our latest review concern various sectors of the Russian economy and branches of law. A raft of important changes to the Russian Tax Code have entered into force: new regulations for property developers and the terms and conditions of forward funding agreements have been introduced; a new procedure for approval of major transactions and related-party transactions has been established; the concept of subsidiary liability for company liabilities has been extended beyond bankruptcy cases; a law on the recovery of damages in favour of creditors has been passed; penalties for personal data law breaches have increased — in particular, seven new administrative offence elements have been added to the Russian Code of Administrative Offences. In addition, a number of significant draft laws are currently being reviewed by the State Duma, including regulations governing the legal status of audiovisual services (online film streaming sites), aimed at safeguarding information security in Russia, and amendments to procurement legislation.

Overview of changes to legislation in July-August 2015

This summer, the Russian State Duma adopted a number of important laws, some of which will be introduced to you in the new survey. With the adoption on 01 July 2015 of the law on PPP, new players may appear on the established concession projects market, which will come out with new initiatives in the PPP field. Moreover, the novel amendments in this law will have a significant impact on regional PPP-projects markets. Employees will now be able to apply for recognition of their employer as insolvent (bankrupt). For actions that have caused failure to fulfil obligations under a state contract, and cause substantial harm to legally protected interests of society and the state, severe administrative fines will be levied. Legal entities registered in a territory, not requiring the disclosure of information on financial operations in relation to legal entities, are prohibited from participating in state tenders. Citizens of the Russian Federation, starting from 01 January 2016, will have the so-called “right to be forgotten” – the right to require an operator of a search engine on the Internet to stop the issuance of links that allow access to personal information.
