VEGAS LEX speaks at defense sector procurement conference

The conference Procurement in the Defense Sector, organized by the Association of Procurement Institutions (NAIZ), took place in Moscow on November 21.

Chairman of the Government Military Industrial Commission, Deputy Prime Minister Dmitry Rogozin opened the meeting.

The discussion addressed the development of a contract system in state procurement and the prospects of public-private partnership projects in the defense sector: centralizing procurement for the national defense and security needs; and state policies and public action that could influence mala fide suppliers fulfilling state defense orders.

Head of the VEGAS LEX Commercial Group, delivered a report Positive Practices and Problems in Defense Companies’ Procurement in Compliance with Federal Laws 223-FZ and 94-FZ. The expert discussed cases where procurement decisions of the Federal Service for Defense Contracts (Rosoboronzakaz) were contested in court; the main types of disputes and the specifics of positive and negative court rulings. She particularly focused on several aspects of the 223-FZ’s enforcement and the prospects of adopting additional legislation stipulating responsibility for violating it.

The conference speakers included NAIZ General Director, head of the Working Group of the Government Expert Council on State Procurement and Investment Sergei Gabestro, who moderated the plenary session; Deputy Chairman of the Military Industrial Commission Oleg Bochkaryov; Mikhail Ivanov, deputy head of Rosoboronpostavka (the federal agency for supplies of armaments and equipment); Ivan Polyakov, CEO of the Interstate Corporation of Development and chairman of the Defense Sector Group at the Federal Inter-Sector Council of the Business Russia organization; Ruslan Pukhov, Director of the Centre for Analysis of Strategies and Technologies; and Pavel Seleznyov, head of the working group of the Military Industrial Commission’s Council for Public-Private Partnership Development, and head of the PPP Committee of the Chamber of Commerce and Industry.

The event brought together over 100 representatives of government agencies, public organizations, academic institutions and major businesses.
