On December 2014 law firm VEGAS LEX supported by the Managers and Developers Guild held a round table discussion «Developer vs general contractor: disputes between the construction contract parties. Important issues».

The partner, head of Real Estate, Land & Construction Practice of law firm VEGAS LEX Igor Chumachenko spoke in detail about the disputes between the construction contract parties based on the following questions: the validity of contract, payment and quality of works, breach of terms, acceptance of works, relations with the subcontractors, organizational and legal schemes of the construction contract performance, peculiarities of the disputes arisen out of the government contracts and others. Together with the participants of the round table he discussed the court practice related to disputes with contractors (sub-contractors), the statistics of the disputes of 2014 with regard to non-performance of contracts, the peculiarities of disputes arisen out of public construction contracts.  He also brought up the topic of the options of contractual relations between the general contractor, customer, technical employer, engineer and other persons engaged in implementation of the construction project including performance of EPC/EPC(M) contacts.

The special guest of the event was Raymond Abu Fadel, country manager at AECOM Russia, who shared his experience of implementing major infrastructure and other construction contracts in Russia.

The topic traditionally arouses great interest and lively response among the professionals due to a great number of disputes between the businesses over different aspects of their cooperation. According to Igor Chumachenko the participation in this event is a good opportunity to stay informed about the current practice of dispute resolution between the customer and the general contractor, in order to prevent significant losses during implementation of investment and construction projects at the stage of structuring the relations (preparation of the general contractor agreement and other related contracts).

Among the participants of the round table were the leaders of the commercial property market, prominent investment and management companies including PPF Real Estate Russia, AECOM, NAI Becar, UMA Capital, INTECO Group, POKROV Investment group and other.
