Untaken loans are presented to the court

In May, the Otradnoe District Court will review a criminal case, filed in accordance with a claim made by Rosselkhozbank, that involves incidents of fraud committed while preparing loans for residents in Kuban’s Uspenskiy District. The recipients of loans that are owed to the creditor argue that either they did not sign any agreement or dispute the amount of funds that they actually received. Experts note that cases where fictitious loans are issued to third parties, including to unscrupulous bank employees, are not unheard of in Russian practice. Lawyers are consulting the victims to petition to suspend civil proceedings before the completion of criminal proceedings in order to preclude the initiation of collection efforts.

“Rostov port” clinging to the land

The Rostov waterfront development project is on hold because the owners of the land – the shareholders of the Rostov Port Group of Companies – do not wish to transfer, without compensation, to the city the plot of land located at 30 Beregovaya Street, on which the port is located, and where they want to create a public recreation area by 2018. The company’s representatives are asking to exchange the 11.6 hectares of land in the central district for 15 hectares in the Zarechnaya Industrial Zone. The municipality insists on the acquisition of the land via auction, while the Regional Ministry of Property claims that it is possible to either exchange sites or purchase the land without holding an auction.

Unpaid public utilities

Tighter government sanctions against defaulters for energy have not yet led to the desired results in the south of Russia. Consumer debt for natural gas and electricity continues to grow, and at an alarming rate especially in the North Caucasus, which remains the most problematic region of the country, in terms of the making payments for public utilities. Market participants believe that to reverse this situation, more active government intervention could be needed – in the formation of the correct tariffs for consumers and improving the legislative framework.

Zaporizhstal pulling for its territory

The Arbitration Court of the Rostov Region refused the claims of the Ukrainian steel plant Zaporizhstal in its lawsuit against Sberbank of Russia PJSC. The combine was intending to challenge a point in the guarantee contract for loans issued by the bank to the Rostov Coal Company LLC for the construction of the Bystryanskaya 1-2 Mine. Earlier, the court satisfied three claims of Sberbank, jointly and severely, to recover $84.2 million from Zaporizhstal and five of its affiliated companies of the Don Region, who acted as guarantors for the Rostov Coal Company LLC.
